An NRI, or Non-Resident Indian, is a citizen of India who resides outside India for the purpose of employment, business, or any other vocation, indicating an intention to stay abroad for an uncertain duration. NRIs maintain Indian citizenship but live abroad for more than 182 days in a financial year. They are eligible to invest in immovable property in India under the guidelines set by the Reserve Bank of India (RBI).
A PIO, or Person of Indian Origin, refers to an individual who is not a citizen of India but has Indian ancestry. This includes those who have held an Indian passport at any point in time or whose parents, grandparents, or great-grandparents were Indian citizens. PIOs were once governed by different rules but are now largely subsumed under the Overseas Citizen of India (OCI) category, which allows them to enjoy many of the same investment rights as NRIs, particularly in real estate.
According to the Foreign Exchange Management Act (FEMA) regulations:
1.NRIs are permitted to purchase both residential and commercial properties in India without prior approval from the RBI.
2.PIOs/OCIs also have similar rights and can acquire residential or commercial properties in India.
3.However, NRIs and PIOs/OCIs are not allowed to buy agricultural land, plantation property, or farmhouses, except through inheritance or with special permission from the RBI.
4.Foreign nationals of non-Indian origin are generally not allowed to purchase immovable property in India unless they satisfy specific residency conditions.
